1. About this shop

This shop is operated by Simon Robin Stephens, trading as Simon Robin Stephens Art, a sole trader in England.

These terms apply to all purchases made through this website.

2. Products

I sell original watercolour paintings, prints, greeting cards, coasters and related artwork products.

Each product listing describes the item, format, price and any relevant production or delivery information. Original artworks are unique and are available only while shown as available.

Colours may appear slightly different depending on your screen. This does not affect your statutory rights.

3. Orders and contract

When you place an order, you are making an offer to buy the selected products.

You will receive an order acknowledgement by email. A contract is formed when I confirm that your order has been accepted or dispatch has begun.

If an item becomes unavailable, or there is an obvious pricing or listing error, I may cancel the affected order and refund all payments made for it.

4. Prices and payment

Prices are shown in pounds sterling. Delivery charges are shown at checkout before payment.

Payment is processed securely through the payment methods displayed at checkout. I do not receive or store your full payment-card details.

5. Making and dispatching orders

Some products are made or prepared after an order is placed. Any estimated preparation or dispatch time is shown on the product page or in the Shipping policy.

I will aim to dispatch orders within the stated timeframe. Unless a different delivery time has been agreed, goods should be delivered without undue delay and normally within 30 days.

Delivery is currently offered to the United Kingdom only unless I agree another arrangement with you in writing.

6. Cancellation and change-of-mind returns

For standard, non-personalised goods bought online, you normally have the right to cancel within 14 days after the day you receive the goods, without giving a reason.

If you cancel:

- tell me within that 14-day period;
- return the goods within the following 14 days;
- take reasonable care of the goods while they are with you; and
- use the cancellation contact details in section 12.

You are normally responsible for return postage unless the goods are faulty, damaged, incorrectly supplied or I have agreed otherwise.

I will refund the returned goods and the basic delivery charge originally paid, using the original payment method. I may wait until the goods are returned or you provide evidence of return. Any permitted reduction for handling beyond what is reasonably necessary to inspect the goods will be explained to you.

Not every made-to-order product is automatically exempt from cancellation. The cancellation exception applies only where goods are clearly personalised or made to your specifications, as permitted by law. If an exception applies, it will be explained before you place the order.

7. Faulty, damaged or incorrectly supplied goods

Your statutory rights are not affected by these terms.

If your goods arrive damaged, faulty or different from the description, please contact me as soon as reasonably possible with your order number and photographs where helpful. I will work with you to provide the remedy required by law, which may include repair, replacement, price reduction or refund.

8. Original artworks

Original watercolours are one-of-a-kind works. Once an original has been sold, it may no longer be available.

The sale of an artwork does not transfer copyright or reproduction rights unless I expressly agree this in writing. The buyer may display the physical artwork for personal use but may not reproduce, scan, copy, resell reproductions of or commercially exploit the artwork without written permission.

9. Intellectual property

All artwork, photographs, text, logos and other content on this website belong to Simon Robin Stephens Art or are used with permission.

You may use the website for personal, non-commercial shopping. You must not copy, reproduce, modify, distribute or commercially use its content without written permission.

10. Liability

Nothing in these terms limits or excludes liability that cannot legally be limited or excluded, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or your statutory consumer rights.

Subject to that, I am not responsible for loss that was not reasonably foreseeable when the contract was made.

11. Privacy

Personal information is handled in accordance with the Privacy policy available on this website.

13. Complaints

If you are unhappy with your order, please contact me first so I can try to resolve the matter fairly and promptly.

14. Changes to these terms

I may update these terms from time to time. The terms applying to an order are the terms displayed when that order is placed. Changes will not affect orders already accepted.

15. Governing law

These terms are governed by the law of England and Wales. If you are a consumer, you will also retain any mandatory rights available to you under the law of the country where you live.
